The core of the protections comes from a unique encrypted client certificate stored in the "TrustZone" core of every Switch unit. That's a change from the 3DS, where users could use a fake token to get around a console-level network ban at least until another ban came down, that is. For Switch games themselves, Nintendo also uses encrypted certificates to verify that the game in question is legitimate when connecting online. That means "sharing of certificates should be fairly detectable, for Nintendo," SciresM writes, and the system fills in a 3DS security hole that involved the reuse of legitimate game-specific header information. For downloadable Switch games, an encrypted ticket inside the game data integrates information about the game with the console's unique Device ID and the Nintendo Account ID used to purchase it.
This method "actually perfectly prevents online piracy," SciresM writes, by cryptographically tying downloaded copies of games to the system and account first used to purchase them. According to his research, Nintendo uses unique certifications for every individual Switch cartridge and copy of a digital game, then checks to see whether those match up with the account that first played them.
As a result, pirated games will get flagged because of the mismatch, leading Nintendo to easily detect and ban the offending consoles from accessing its online service.

I feel like this generation its going to be hitting hard.Not long after its March launch last year, it was revealed that a GPU exploit in the Nintendo Switch could be used to run unofficial software, like pirated games and homebrew ROMs. Since then, the Switch's hacking community has grown, and the discovery of a new 'unpatchable' exploit last month has only made the console more attractive to pirates and homebrew fans.
Nintendo isn't taking the assault on its walled garden lightly, however, and is taking steps to crack down and dissuade users from taking advantage of the security holes. The Japanese company has begun banning hacked consoles from its online services, sending error notifications when users attempt to log in.
The incident was first reported by Switch enthusiast Shiny Quagsirewho said the error message popped up on an unhacked switch, meaning Nintendo has applied the ban to a Nintendo user account, which could affect multiple Switch consoles if the user owns more than one.
The ban restricts users to playing games on their console only with most online services disabled, though it appears news updates are still coming through. Access to the eShop, playing online games and interacting with the Switch community are all blocked, however.
